PALM HARBOR, FL (WFLA) -

The driver in the Palm Harbor hit-and-run case that injured a night club bouncer had planned to turn himself in Wednesday. But then, Jack Ayyub had second thoughts.

Instead, Ayyub and attorney Barry Cohen contacted the Florida Highway Patrol and the Pinellas-Pasco State Attorney's Office to tell his side of the story.

Surveillance video released by the FHP shows Ayyub running over bouncer Doug Berube in front of the Silks Club on U.S. 19 on Friday. It also appears to show the confrontation that led up to that end.

Ayyub says Berube and a DJ From the club were upset at his friend urinating outside and confronted them. When Ayyub tried leaving, he says the men attacked.

"They came and wanted to drag me out of my window. Cursing, screaming what they wanted to do to me," said Ayyub. "I'm not sure about anybody else, but when your life is on the line, you're terrified for your own life, I don't know, somebody drags you out of your window, what do you think they're going to do to you next."

Cohen added, he believes Ayyub is the victim of a felony battery.

"The bouncer and the DJ, they had no business sticking their arms and committing a battery on my client," said Cohen. "They put their hands in a conveyance, with the intention to commit a battery. That's a felony."

Cohen and Ayyub met with the investigating trooper, once the investigation is complete, it will be reviewed by the state attorney's office. Prosecutors will decide if formal charges should be file.

Cohen is confident they won't go that route. And once this case is resolved, he plans to sue the night club, the bouncer and the DJ who were involved.
