NC judge set to rule on teacher tenure law's fate

Posted: Updated:
RALEIGH, N.C. - A North Carolina judge in Raleigh is set to make the first ruling in a legal battle over public school teachers and whether they're entitled to keep job protections in place for generations.

Superior Court Judge Robert Hobgood is expected to rule Friday in a lawsuit challenging a law that orders school districts to give the best 25 percent of teachers four-year contracts. The teachers would get pay raises totaling $5,000 but lose their tenure rights.

Lawyers representing state lawmakers and public school teachers say Hobgood has enough information to decide without a trial whether the law is constitutional.

North Carolina law for more than 40 years has said veteran teachers cannot be fired or demoted except for a series of listed reasons that include poor performance, immorality and insubordination.
