No death penalty for New Tampa mom accused of killing kids

TAMPA, FL (WFLA) -

Prosecutors have decided to not seek the death penalty in the case of Julie Schenecker, the New Tampa mother charged with murdering her two teenage children.

The Hillsborough County State Attorney's Office made the announcement on Tuesday.

"After being provided overwhelming evidence of mitigation due to the mental health issues of the defendant, it was determined that the imposition of the death penalty in this case would not withstand the scrutiny of the Florida Supreme Court," the State Attorneys Office said in a statement.

Schenecker is accused of shooting and killing her 13-year-old son Beau and her 15-year-old daughter Calyx in January of 2011. Investigators

say Schenecker shot her daughter for being mouthy and her son for talking back to her.

In February, prosecutors sought a mental evaluation for Schenecker to find out if she suffered from a mental illness. Her attorneys plan to seek an insanity defense.

Schenecker is charged with two counts of first degree murder. Her trial is scheduled to begin in October.
