Fair ride owner plans to plead not guilty in incident

RALEIGH, N.C. -

The second man arrested in connection with a ride accident at the North Carolina State Fair that hurt five people plans to plead not guilty in the October incident.

Joshua Macaroni, 32, drove from his home in Georgia to Raleigh to turn himself in to Wake County authorities Thursday evening after being charged with three felonies in connection to the accident on the Vortex ride. He was released on a $225,000 secured bond. He is charged with assault with a deadly weapon. More charges could be coming.

Macaroni was in court Friday morning for a first appearance, where the judge issued a court date of Nov. 18.

Afterwards, Macaroni's Raleigh-based attorney, Dan Boyce, said, "Josh was shocked when he first heard about the accident. Josh was equally shocked when he heard charges were being filed against him individually. He's been given no factual basis for the charges against him."

Boyce told WNCN Thursday that his client was shocked when he heard about the accident at the state fair and that he's "puzzled as to why Josh was charged." Boyce said Friday that his client plans to plead not guilty to all three charges.

"We look forward to working with law enforcement so we can learn their theory on why Josh is somehow partly responsible for this terrible tragedy," Boyce said.

On Thursday, Wake County Sheriff Donnie Harrison said investigators had probable cause to charge Macaroni.

"If somebody tampers with something, then they knew something wasn't right," Harrison said. "If you ride down the road and your tire runs off, that's just one of those things. But if you knowingly, somebody knowingly takes the lugs off your tire, then I've got a problem with that."

Deputies previously arrested ride operator Timothy Dwayne Tutterrow, 46, of Quitman, Ga., on Oct. 26 and charged him with three felony counts of assault with a deadly weapon inflicting serious bodily injury.

Tutterrow, who was employed by an independent ride contractor, is suspected of tampering with the ride, Wake County Sheriff Donnie Harrison said.

The Vortex remains at the State Fairgrounds and investigators told WNCN it is expected to remain through the investigation.

More arrests could follow.
