Parrish couple files suit to legally grow marijuana

MANATEE COUNTY, FL (WFLA) -

A Parrish couple is suing the Manatee County Sheriff's Office. Robert and Cathy Jordan are fighting for permission to grow marijuana for medical use.

"I can't say this enough! We don't want to do this!" said Robert.

Robert and Cathy Jordan are both trapped. Cathy is trapped in a body that's wasting away, and Robert feels unable to help.

"I want to be able to do this without fear of going to jail," he said.

In 1986, Cathy was diagnosed with ALS, or Lou Gehrig's disease, and she smokes cannabis, otherwise known as marijuana.

"She'd be dead. If it wasn't for cannabis, she'd be dead," said Robert.

She says it slows the progression of her disease. So Robert grew the plants out in the backyard, but in February, deputies confiscated it and later dropped charges. So now the Jordans are suing the sheriff's office, they want legal permission to grow marijuana for medicinal use.

Cathy said, "What I want is safe access for all patients in Florida. I want to keep myself alive."

The Jordans also hope to help other Floridians in a similar bind. Manatee County Sheriff Brad Steube couldn't say much.

"No, I can't comment," he said. "It's a pending lawsuit. Our stance when we're being sued is not to comment."

Robert says he still obtains marijuana to help his wife.

"They're making us go to the street. We gotta go to the street and buy this," he said. "You have to, you have to take your medicine."

He's concerned about the quality of the street drugs, so he hopes to be able to legally grow the medicine himself. Robert said he has no intention of moving to another state where marijuana use is legal.

"We're living in paradise, man. We got a swimming pool in the back, we got beautiful weather, why would I move anywhere else?"

The Jordans say this lawsuit is just the beginning. They're willing to take the fight all the way to the US Supreme Court.
